BANGKOK, THAILAND – Shooting an intruder in your home does not make you a criminal or a hero by default. Police say the moment tells the whole story.
Police spokesman Tri Rong Phiwaphan made it clear: there is no blanket right to open fire. The fact someone entered your house or died inside it is not enough for a legal verdict.
No blanket right to shoot intruders
Investigators check if there was an immediate threat to life, body or property. They ask if the reaction was proportionate to the danger.
Tri listed key factors: an intruder who comes at night, moves toward the resident, or ignores orders to stop. Each changes the legal picture.
Article 68 protects reasonable self-defence
Under Article 68 of the Criminal Code, an act is justified if an unlawful threat is imminent and the defence is reasonable. If both conditions are met, no crime has been committed.
But the moment the danger ends, the rules shift. If the homeowner then chases the intruder or keeps using weapons, the legal assessment flips.
Excessive force can be leniently judged
Article 69 applies when defence was valid but went beyond what was needed. The court may then impose a lighter penalty than the law normally requires.
Judges can even drop punishment entirely if the excessive force came from excitement, shock or fear. Whether that applies depends on the specific facts of the case.
Police secure evidence and investigate
When someone dies from a gunshot, police must examine the scene, test the weapon and analyse forensic evidence. They also collect CCTV footage and statements from witnesses and others involved.
Investigators then piece together exactly what happened when the trigger was pulled. Prosecutors and, if needed, a court review the evidence and the established facts before making a final call.
